在留期限もなく，就労制限もない永住者としての在留が許可される外国人は，日本にとって利益があると日本政府の法務大臣が認めた者だけです。いくら外国人側から永住したいと希望しても，日本政府が認める条件をクリアしていなければ永住許可はもらえません。これらの条件には以下のようなものがあります。

1. 法律などのルール違反をしていないこと
2. 独立して生活できるお金と技能があること
3. 日本にとって利益があること

そして，上記の条件を判断するためには次のようなことが審査されます。

• a.法律を遵守し日常生活においても住民として社会的に非難されない生活をしているかについて，各種税金や年金を納付期限を守って支払っているか。交通違反，その他罰金刑以上の違反が過去5年以内にないか。
• b.家族全員が生活できる収入があり，住民税等の税金が課税される状態できちんと納付しているか。
• c.引き続き10年以上日本で生活していて，そのうち5年以上は就労系在留資格であるか。この期間について，90日以上日本を離れたことがないか。

上記C.の「10年」の期間は，日本人または永住者の配偶者ビザの場合は３年（子は1年），定住者ビザの場合は５年，高度専門職の場合は1年～3年となります。

Foreigners who are permitted to stay as permanent residents, with no period of stay and no work restrictions, are only those who are recognized by the Japanese government's Minister of Justice as having an interest in Japan. No matter how much a foreigner wishes to live permanently, he or she will not be granted a permanent residence permit unless the conditions approved by the Japanese government are met. These conditions include:

Not violating any laws or rules
Have the money and skills to live independently
be beneficial to Japan

In order to determine the above conditions, the following will be examined:

a. Are you observing the law and living your daily life without being criticized by society as a resident? Are you paying various taxes and pensions on time? Have there been any traffic violations or other violations punishable by a fine or higher within the past five years?
b.Does the family have enough income to live on and do they pay resident tax and other taxes properly?
c. Have you continued to live in Japan for 10 years or more, of which 5 or more years have been under an employment status? Have you ever left Japan for more than 90 days during this period?

The period of ``10 years'' in C. above is 3 years (1 year for children) for a spouse visa of a Japanese or permanent resident, 5 years for a long-term resident visa, and 1 year for a highly skilled professional. It will be ~3 years.

・公的義務を履行していること
これは，課税・納税証明書（通常は５年分見ます），健康保険税納入状況証明書，および国税の証明書を取得し，未納がないことが必要です。
年金記録照会をして，過去２年以上遅滞なく支払っていること。
健康保険や年金は，社会保険の場合，または６０歳以上の場合は問題となることはほとんどありません。
会社を経営している「経営・管理」の場合は，社会保険加入が必須であり，常勤の従業員の加入も必要です。
同居家族がいる場合はその家族のものも含めて公的義務を履行しているかどうかが審査の対象となります。

・経済的安定性があること
これは，あなたが何人で生活しているかを含めてみます。あまり収入が少なく同居家族が多い場合，これが原因で不許可となることがあります。

・法令違反がないこと
略式命令による罰金以上の刑などがあれば，そこから５年以上は許可されません。
単なる交通違反はケースにより判断されます。

・Fulfilling public obligations
This requires obtaining a taxation/tax payment certificate (usually 5 years worth), a health insurance tax payment status certificate, and a national tax certificate, and that there are no outstanding payments.
Check your pension records and make payments without delay for the past two years or more.
Health insurance and pensions are rarely a problem if you are covered by social insurance or if you are over 60 years old.
If you are a "business manager" who runs a company, you are required to enroll in social insurance, and full-time employees are also required to enroll.
If you have family members living with you, whether or not you are fulfilling your public obligations will be subject to examination, including those of those family members.

・Financial stability
This includes how many people you live with. If your income is low and you have many family members living together, this may lead to your application being rejected.

・No violation of laws and regulations
If there is a penalty greater than a fine due to a summary order, permission will not be granted for more than five years.
Simple traffic violations are determined on a case-by-case basis.
